Chapter 7

This is straight bankruptcy—it generally will discharge all unsecured debts such as credit cards, medical bills, collections, signature loans, etc. With respect to secured debts (house and car loans), if you want to keep the property, you usually can. However, you will have to continue to pay that creditor.

Upon filing a bankruptcy case, an order for the automatic stay goes into effect. This order does many things, but of particular importance to someone who is filing for bankruptcy relief, this order:

  • Prohibits creditors from contacting you by telephone, mail, or otherwise to demand repayment; taking any actions to collect money from you or try to obtain property from you, repossessing your property, starting or continuing lawsuits or foreclosures, and garnishing or deducting from your wages or bank accounts.

What you need to bring with you on your first appointment:

  • Income for 2021 (can get it off of your 2021 tax returns*)
  • Income for 2022 (can get it off of your 2022 tax returns* or your last paystub for 2022)
  • Income for 2023 (can get it off of a recent paycheck stub)
  • All paystubs from all sources received in the last 60 days
  • Documentation for any lawsuits, garnishments, or judgments
  • Bills from all creditors (including house and car loans), collection agents, or collection attorneys. If you do not have a bill, you will need:
    • The name and address of each creditor
    • The approximate amount owed to the creditor
    • Account number, if available

*Copy of your 2021 and 2022 tax returns (or just 2021, if your 2022 tax return is not yet done)

Chapter 13

This is debt reorganization. It will require you to pay a monthly payment to a trustee for 36-60 months through a wage withholding with your employer. At the end of all payments to the Trustee, you will be granted a discharge of the unsecured debts such as credit cards, medical bills, collections, and signature loans (regardless of how much the creditor actually received from the trustee). You can pay arrears on house payments through the plan and can (and usually must) pay vehicle loans.

What you need to bring:

  • Income for 2021 (can get it off of your 2021 tax return*)
  • Income for 2022 (if 2022 tax returns are not done, you will only need your 2021 tax return*); you can get your 2022 income off of your last pay stub for 2022 or your W-2
  • Income so far for 2023 (can get it off of your most recent paystub)
  • All paystubs from all sources received in the last 60 days
  • Documentation for any lawsuits, garnishments, or judgments
  • Bills from all creditors (including house loans and car loans), collection agents, and collection attorneys. If you do not have a bill, you will need:
    • The name and address of each creditor
    • The approximate amount owed to each creditor
    • Account number, if available
